To be eligible for settlement based on your status as a Work permit visa holder, certain eligibility criteria must be met. Importantly, you should have stayed in the United Kingdom for a minimum of five years; continuously residing in the same visa category or any combination of Tier 2 visas.

You will be able to make this application 28 days before you qualify for ILR. This means that you may consider to submit your application for indefinite leave to remain after spending a minimum 4 years and 11 months continuously in the UK.
