Tier 2 Sponsorship Licence Success

Our immigration solicitors were instructed to assist with a Tier 2 (General) sponsor licence as our client had identified a prospective employee for a skilled role. The prospective employee was at the time on a Tier 2 (General) visa and was sponsored by another employer.

The new sponsoring company did not have a Sponsor Licence but wanted to sponsor the candidate.

The first step we took was to identify the relevant Code for sponsorship as set out in Appendix J of the Immigration Rules.

The starting point for the majority of acceptable roles for vacancies would be that the company will need to advertise the vacancy on two platforms for at least 28 days. This proved to be the case with the company and so we advised and assisted the company in ensuring that the adverts met the Home Office's Resident Labour Market Test.

Whilst the adverts were running, we advised the company on the documents required for a Sponsor Licence. The company was able to provide evidence that it was a genuine organisation operating lawfully in the UK. With our advice and guidance, we were also able to help the company amend its HR systems to ensure that the company would comply with its duties as a Tier 2 Sponsor.

The application for a Sposnor Licence was granted. Thereafter we advised and assisted the company in applying for a Certificate of Sponsorship Licence and assigning the same to their prospective employee. The employee was soon thereafter issued with a Tier 2 visa post a Change of Employer application and is now working with the company.
