Tier 1 Graduate Entrepreneur Switching To Tier 1 Entrepreneur

Our client instructed us to help with his Tier 1 Graduate Entrepreneur visa application. He had previously worked with the same firm on his Tier 1 Graduate Entrepreneur visa. He now wants to switch into the Tier 1 Entrepreneur route, relying on funds already invested. Furthermore, he is a shareholder and Director of the company and has a progressive set up.

Our immigration solicitors needed to show evidence of the investment of the £50,000 into a business in the UK is available. Money invested will normally be considered as long as we produce suitable evidence of this with the application in line with the time limitations of previously invested funds;

We further showed that the applicant has a viable business idea presented to the decision maker for review. As the client was already running his business, this aspect of the rules was relatively easy to illustrate. We still needed a business plan despite the business being in operation.

The applicant needed to have the required level of English language. It was easy to evidence this as he had graduated from a UK institution. At least that was how he got a Tier 1 Graduate Entrepreneur visa in the first place. The Application was subject to a Genuine Entrepreneur Test; as of 31 January 2013 the Home Office introduced a subjective element into the requirements for initial application in order to filter out those applicants they felt were not obtaining the visa for genuine business activity. We ensured that we evidenced why the client business is a genuine one and the client is a genuine business person. We will discuss this further and continue to work on this requirement whilst preparing the documentation.
