Obtaining a Spouse Visa and Dependant Visa.

Obtaining a Spouse Visa and Dependant Visa.

I need advice to obtain a Spouse Marriage Visa and three dependents to come to UK and I am already resident here for 45 years. I have adequate salary and three properties and I can support my wife here and we want to get married in the UK. I understand the basics, but you can cover all the finer points. We have known each other since 2008 and became closer in 2015 and I travelled to meet with her and I am in constant touch and intend to visit her this year. She speaks several languages and has an excellent grasp of spoken and written English. I also can show our commitment and we come from the same community and so there is a common culture and ethnicity. I want the family to move here so we can get married and live together. Please let me know what information you need to make a full assessment and also to prepare the visa applications. I will be happy to share any information you might need to arrange these matters and please let me have an estimate of your costs and about your success rate in these matters. I know that I need to have sufficient income for additional dependents and my family would not need use of any public funds for 5 years. If you initial consultation can be on a face to face basis - I would need to take a day off to come to Central London. I am happy to pay a reasonable cost for your time. Thank you

Our response

Thank you for getting in touch with us and for providing detailed information.

You mentioned that you would like to make an application for a spouse visa for your "wife" and at the same time "get married in the UK". Whilst I am unable to ascertain the status of your relationship, I will outline both the requirements for the spouse and the fiancé visa.

First, in order for you to make an application for them, you, as the sponsor must either be British or Settled. You mentioned that you have been a UK resident for 45 years. You must be a holder of a British passport or must have been granted Indefinite Leave to Remain in the UK.

There are 4 main requirements that applicants need to satisfy:

You must show that the relationship is genuine and subsisting

The onus is on you and the applicant to evidence this. If you are already married, you need to submit an original copy of your marriage certificate and English translation if applicable. In addition, you will need to provide other evidence of communication and evidence that you have met.

You must show that the financial requirement is met

Although it is unclear from your question, I would assume that the children you mentioned are your biological children. As you have 4 dependants, you are required to show that you have an annual gross income of at least £27,200. You may rely on your salaried employment for 6 months, income from self-employment/company directorship (12 months) or cash savings.

The spouse applicant must evidence proficiency in English language

Your wife must submit an evidence by way of an original certificate that she successfully passed an English language test at level A1. Alternatively, if she has obtained a degree, this must be assessed by UK-Naric to confirm that is thought in English at the appropriate level.

There must be adequate accommodation

You mentioned that you have three properties. You must evidence that you can accommodate them without any recourse to public funding. You may evidence this by showing ownership of a property that is ideally exclusively occupied by you. It is also important to note that as there will be 5 of you, the property must not contravene the regulations as set out in the Housing Act 1985.

There are other requirements such as Tuberculosis testing and evidence that the previous marriage has broken down but these need to be discussed once we have more information on your circumstances.

"Anna Foley was the lawyer helping my partner obtain an EEA EFM visa. She was outstanding. Handling the case with constant correspondence over a lengthy, lockdown delayed 7-month application process. Her expert advice guided us successfully through some difficult times as a result of COVID-19. Some of the best service I have received for any service ever! Often replying to emails late at night, offering to send additional correspondence to the home office and going above and beyond in handling our case! Well done and thank you Reiss Edwards and thank you Anna!!".
