Would Leaked Government Rules Affect Immigration

Would Leaked Government Rules Affect Immigration

With all the talk of huge changes in the future of hiring staff, it is of little surprise that many small businesses are seeking help and guidance in the future of their staffing. Draft changes that have been leaked show a large move by the government to tighten the rules on foreign workers in the UK. So how can you best prepare yourself for the changes that may be coming?

Tier 2 Sponsor Licence

The Tier 2 sponsor licence scheme allows eligible businesses to hire foreign workers to come and work in the UK. This allows for ultimate flexibility for hiring staff but comes with some strict conditions on monitoring and record-keeping that mean that it may not be right for all businesses or that the business may need to use an outside firm such as ourselves to manage their records to ensure continued compliance.

Keeping In Contact With Your Staff

Some of your EU citizen staff may be considering going home, even if they haven't communicated it to you at this point. If this is the case then it may be prudent to try and offer advice to those who seek it but be careful not to single out staff. Reassurance that the business will do what it can to keep its staff after "Brexit" may mean some guarantee of certainty for those who will probably need it given all of the uncertainty around the future of them now.

Permanent Residence

If staff are eligible then it may be prudent for them to apply for indefinite leave to remain now rather than wait for future changes. If the draft legislation has shown anything, it seems that the system will get harder for foreigners in the UK rather than easier and now be a better time than any to ensure their status in the UK.

Seeking Counsel

Immigration lawyers will be at the forefront of what is going on and are likely in the best position to advise how to proceed with your staff. These companies will likely have some solutions that mean that you can give assurances to your staff and show them that you have their best interests at heart. Approaching the issues now means that you may be well prepared going forward and are less likely to get caught out by potential changes to workers rights to remain in the UK.

How We Can Help

Our experienced immigration solicitors offer a wide range of solutions that mean we can help to ensure the status of your staff in the UK. We can advise you of the best course of action going forward and can even help you to go for the Tier 2 sponsorship licence so that you do not lose your ability to bring in foreign workers after "Brexit". "Anna Foley was the lawyer helping my partner obtain an EEA EFM visa. She was outstanding. Handling the case with constant correspondence over a lengthy, lockdown delayed 7-month application process. Her expert advice guided us successfully through some difficult times as a result of COVID-19. Some of the best service I have received for any service ever! Often replying to emails late at night, offering to send additional correspondence to the home office and going above and beyond in handling our case! Well done and thank you Reiss Edwards and thank you Anna!!".
